Service Agreement, Terms and Condtions for Lay-by Payments
Please read very carefully our lay-by service agreement to ensure transparency between you (the client) and Australian Custom Designed Timber and what is expected from you.
Here are the steps that will be adhered to when choosing to use our lay-by agreement:
It's when the client makes at least two payment instalments towards the full amount of the agreed total price payable for the custom order or goods. The client does not receive the goods (completed or not) until the full price has been paid. The initial deposit of 30% is considered as an instalment and will go towards paying the total price and this deposit will secure the current price for the goods to be made. Each payment instalment amount must be paid within or on the exact scheduled agreed dates. Failure to do this may result in the termination of the agreement and will incur any termination fees as per the agreement.
Once you have agreed to the estimated quote and have confirmed the requested completion date you must pay a 30% deposit of the total price of the custom order along with a document with a schedule for when each payment amount is due on the specified dates (weekly, fortnightly or monthly dates) until the full amount has been paid for the goods (minimum of 6 weeks and up to 6 months from the deposit date).
Eligibility: The client must be of Australian legal adult age of at least 18 years old, the client must supply a valid billing/delivery address for billing and security purposes, and the client must be currently residing or soon to be residing in the provided delivery address.
Each scheduled lay-by payment will be supplied with an individual tax invoice with the agreed instalment amount and payment options such as cash, card (Visa cards or MasterCards only) or bank transfer payments. Please kindly note that we do not accept American Express cards or Amex cards or any other card payments.
Again, if the client misses a payment, the agreement may be terminated and client will need to pay the termination fee.
Until the full amount is paid, the goods (even in its completed form) will remain with Australian Custom Designed Timber. Once the balance is paid and within the agreed time of 6 months (and no more) then the goods will be released/dispatch/delivered.
You must provide a requested completion date of a minimum of 6 weeks or a maximum of 6 months from the deposit payment date. This requested completion date must not be less than the estimated turnaround time provided to you (Please see Turnaround Time). The ACD Timber team must complete your order by the requested completion date and not before or after.
Requests to complete production earlier than the requested completed date, at any stage after the agreed lay-by contract has been signed and deposit payment has been made, will not be implemented and the order will be completed by the specified completion date and not before (Also related Changes to the lay-by length (Shorten payment length)).
An estimated turnaround time will be given to the client prior to starting the build. The turnaround time will vary depending on the quantity and size(s) of custom items ordered. A requested completion date must be given by the client (For lay-by only) and the requested completion date must be at least 6 weeks and up to 6 months from the deposit payment date. The client can still pay the balance owing before the payment term ends and before the completion of the turnaround time, however this does not mean that the build MUST be completed upon the early lay-by payment completion by the client and the build will be completed according to the estimated completion time outlined.
All goods (whether in production or completed) will not be released or dispatched until all outstanding lay-by amounts have been paid prior to collection, dispatch or delivery.
Production for all lay-by orders will begin at least 6 weeks before the completion date specified. This will depend on the turnaround time given and will be based on the quantity and size(s) of custom items ordered. The client will be notified of the commencement date.
If the client has paid the remaining balance within the 6 month period and still requires more time before delivery (i.e. The new house build will not complete for another month), Australian Custom Designed Timber does not charge any storage fees to hold the complete goods for up to another 6 months from full payment date.
A delivery date and time will be arranged with the client after production is complete and all outstanding balances are paid.
Please kindly note: Australian Custom Designed Timbers does not delivery to above ground-levels/split-levels of homes or apartments, and if delivery is required to above ground-levels/split-levels of homes (I.e., Second floor, lower split-level and etc.) then it is up to the client to arrange the required help to lift and move the ordered items to those specific areas.
Australian Custom Designed Timber offers a minimum of 6 weeks payment term and up to a maximum of 6 months payment term with no interest and no monthly fees charged where payments of a set amount are calculated to suit a weekly, fortnightly or monthly schedule to meet the full agreed price prior to or upon the lay-by payment term deadline.
If the client would like to schedule the lay-by payments to be completed before the 6 months payment term (Must not be less than the minimum of 6 weeks payment plan and must not be less than the estimated turnaround time provided to you), please contact us at least 4 weeks prior to increasing the scheduled payment amount. There is no early payment fee or early payment completion charge. Again, the client will be provided in writing an updated payment schedule whereby the client must approve and sign the updated lay-by agreement before proceeding with the new instalment amounts.
If at any stage the agreed total price exceeds the initial quote and agreement due to the client requesting further modifications to the custom order (whether is it adding, removing, changing colours and etc.), production for that order will pause, the client will be notified in writing with a new expected final price and the client must approve and sign the updated lay-by agreement before proceeding with the new instalment amounts.
Australian Custom Designed Timber reserves the right to terminate the lay-by agreements or cancel orders at any stage of the custom build (Whether in progress or after its completion) if the client breaches the terms of the agreement (i.e. Missing a scheduled payment, violating any other terms of service) and will inform customers in writing as soon as practicable to notify the client of the termination. The client reserves the right to terminate or cancel the lay-by agreement at any time before the delivery of the goods. A termination fee will be applied if the client cancels the lay-by agreement.
As per the lay-by agreement of the total price payable and date of acceptance, if the client's lay-by payments do not cover the termination fee, Australian Custom Designed Timber holds the right to recover any and all outstanding amounts pertaining to the agreement as a debt.
Upon termination, all payments and deposits that have been made towards a lay-by agreement will be forfeit and are non-refundable. As all orders are individually made using a customised service, each item is one-off and not pre-made with a set re-saleable price. Whereby payments made are absorbed by materials, time and labour service costs.
It is the client's obligation to read and understand the terms and conditions of the lay-by service outlined in its entirety before committing to the lay-by agreements with Australian Custom Designed Timber.
